TERMS & CONDITIONS OF ENGAGEMENT

I give authority to Your Refund Limited to act on behalf of myself for all tax types until further notice. Authority is given to obtain information from Inland Revenue about all tax types. This includes obtaining information through all Inland Revenue media and communication channels, and to ‘link’ me to their tax agency client list with the IRD until I notify Your Refund Limited or the IRD to cancel this authority. I acknowledge that this gives Your Refund Limited the authority to do all of the following:

• delink me from my previous agent's list. If I choose to delink Your Refund Limited as my agent I accept responsibility for notifying the IRD or my new tax agent to remove the Your Refund Limited Trust Account from my records held by the IRD.
• obtain and retain all information necessary for Your Refund Limited to perform the services requested, including information from IRD in regards to all my tax types, including income tax, student loan, ‘Working for Families’ and rebates, and all other tax matters, by any available contact method, including phone, internet, fax, mail, email and all e-services; and prepare and sign all tax returns on my behalf.
• obtain from any financial institution any relevant information that may affect the assessment of my refunds.
• on linking, all correspondence relating to income tax will be sent to Your Refund Limited. All correspondence from IRD relating to any other tax type or matter will continue to be sent directly to me unless IRD holds an invalid address in which case it will be redirected to Your Refund Limited. I understand that it is my responsibility to ensure that both Your Refund Limited and IRD have my current address.
• reserves the right to withdraw me from their services and ‘delink’ themselves as my tax agent with the IRD at any time and without notification. I agree that should this occur I will still be liable to pay Your Refund Limited any fees which were incurred prior to their withdrawal.

Your Refund Limited has relied upon the information submitted by me and provided it to IRD. Therefore I acknowledge that I am solely responsible for ensuring that all information I provide or that is provided on my behalf to Your Refund Limited is complete and accurate and that Your Refund Limited does not undertake any audit or verification of such information.

I acknowledge that submitting an application also constitutes my electronic signature.

Refer to the Our Fees page of Your Refund Limited for the fee structure as it constitutes part of the Terms & Conditions of Engagement.

Also note, our total liability to you for any one event or a series of related events arising out of the performance of the services or your use of our services or otherwise, and whether in contract, tort (including negligence), breach of statutory duty or otherwise, will be maximise to the fee we collected (if any) in aggregate.

I authorize Your Refund Limited to:

• receive any refund for any tax type on my behalf and arrange for this to be deposited into the nominated Your Refund Limited Trust Account.
• deduct from such refunds any applicable service fees or any other fees as detailed above and understand that this will solely be based on Your Refund Limited assessment.
• pay the net balance of the refunds to me by direct credit into my Bank Account with the account details as supplied by me.

In the event that any portion of my refund is transferred to any tax type arrears, I acknowledge that Your Refund Limited may withhold an amount equivalent to the value of their assessed service fees. In the event that any fees remain outstanding, I authorize Your Refund Limited to deduct such fees from any future refunds received by them on my behalf.

Your Refund Limited will not be responsible for any money deposited into a bank account provided by me in error.

I authorize Your Refund Limited to utilize my name, address, date of birth, marital status, contact information, IDs, financial status, credit information and tax refund amount on its website.

I acknowledge that if my application for a tax refund is not received before 25^th March 2018, it may not be processed before 31^st March 2018, and therefore I may lose the possibility of a refund for the 2013 tax year. IRD may time-bar the 2013 financial year at any stage which is beyond the control of Your Refund Limited.

I understand that while Your Refund Limited aims to pay the net balance of my tax refund to me within 4-5 working days from the date I make my application, this time frame may be increased by delays at the IRD.

I understand that tax refunds for the most recently completed tax year which ends on 31^st March will not be issued until mid-June (at the earliest).

I agree that Your Refund Limited may verify my ID by Photo Identification, Address Verification, NZ Driver Licence verification, and/or NZ Passport verification.

I agree to receive emails, text messages (SMS) and/or phone correspondence relating to my tax refunds and returns - including reminders to reapply, questions regarding my tax affairs, and important dates, in accordance with the preferences indicated in my application, and as updated from time to time.

Please note: charges may apply depending on your mobile phone contract with your provider.

I understand that I may receive marketing emails from Your Refund Limited from time to time and that, if I do not wish to receive such marketing emails, I can contact Your Refund Limited by logging on to the website and sending an internal message for such requests.

I understand that should I choose to ‘delink’ Your Refund Limited as my tax agent, I can contact Your Refund Limited at any time to unsubscribe from future correspondence  by logging on to the website and sending an internal message for such requests.

I agree to meet the following general responsibilities:

• comply with these Terms & Conditions of Engagement;
• receive services from Your Refund Limited for my own personal, non-­commercial use;
• follow instructions and directions from Your Refund Limited in relation to using yourrefund.co.nz and the services they provide;
• adhere to all applicable rules, regulations, standards, and codes when using yourrefund.co.nz and when receiving services; and
• use information acquired in connection with yourrefund.co.nz solely for the purpose of receiving services from them.

• I acknowledge that neither Your Refund Limited nor any of its directors or employees accept the responsibilities or liabilities for the accuracy of the information from which the PTS/tax returns have been prepared;
• I agree that I am liable for any payment required by IRD as a result of Your Refund Limited filing my tax return(s) or requesting PTS on my behalf;
• I agree that nothing in these Terms creates evidence of any partnership, joint venture, employer/employee or fiduciary relationship with Your Refund Limited;
• I acknowledge that Your Refund Limited has no obligation to provide or continue to provide access to this website;
• Except to the extent required by law, Your Refund Limited (including all directors, employees, contractors and agents of Your Refund Limited) make no warranties or representations relating to or in connection with the services provided (whether express, implied or whenever arising), originating in statute, law, trade, custom, or that would otherwise apply. If this exclusion of liability cannot be relied upon, or Your Refund Limited is liable for any reason, then the maximum combined liability in connection with the use of this website, and receipt of services from Your Refund Limited, will be limited to the value of the services received in connection with the event to which the claim relates. This limitation does not restrict any rights that may exist under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
• Your Refund Limited makes no representation that this website, or the services it provides, are appropriate or available for use in locations outside of New Zealand. Persons accessing this website, utilizing or receiving Your Refund Limited services in locations outside of New Zealand do so at their own risk and are responsible for compliance with local laws.

Your Refund Limited owns or is licensed to use all intellectual property rights in the content, software and anything made available in connection with this website (“IP Rights”). All title, interest and rights (including but not limited to ownership and intellectual property rights) in the IP Rights will remain in Your Refund Limited and/or its providers. I acknowledge such title, interest, and rights in the IP Rights and will not take any action to jeopardize, limit or interfere with in any manner.

Your Refund Limited may amend these Terms & Conditions of Engagement ("Terms") at any time. I acknowledge that it is my responsibility to ensure that I am aware of the Terms currently applying and that the continued use of this website and/or my receipt of services from Your Refund Limited indicates my acceptance of any changes made. If I do not agree with a change made to these Terms, I acknowledge that it is my responsibility to contact Your Refund Limited to opt-out of Your Refund Limited’s services at any time.

Services provided by Your Refund Limited are provided under New Zealand law.

All information Your Refund Limited obtains in the course of this engagement is subject to confidentiality requirements, in addition to obligations under the Privacy Act 1993. Your Refund Limited will only disclose that information to other parties in accordance with Your Refund Limited’s Privacy Policy or as required by law.

I understand that I have the right to request a copy of the information about me retained by Your Refund Limited, and the right to request the correction of any incorrect information about me held by Your Refund Limited.
